A pizza delivery man filed a civil action against a townhouse owner, alleging that one night, while delivering several pizzas, he tripped on a loose brick on the pathway to the townhouse's front door. The townhouse owner maintained that the loose brick was visible in the moonlight, and she called her neighbor as a witness. During direct examination of the neighbor, the townhouse owner's attorney asked her if the moon was out on the night in question. The neighbor testified that she remembered her daughter telling her when she came inside that the moon was so bright that it was almost impossible to see the stars.
