What are two criticisms of the seniority rule?

The Seniority Rule, which states that members of Congress can have first pick in some situations based on how long they have served is criticized because it doesn't take into account merit.

d) supreme court of justice. to counteract the rigidity of the written constitution, judicial action is required to interpret said constitution and necessary changes can be made.
