Mr. Allan and Mr. Siwisa agreed to play $100, on a fifty-fifty basis on special numbers in the weekly lottery of St. Siven. They agreed to share the winnings and the losses, fifty-fifty. One week, Siwisa was late in paying half of the lottery fee. Allan paid the full $100 for the sheet of ticket. The special numbers won $1 million. Allan refused to share the winnings with Siwisa on the grounds that it was his money, and that Siwisa was late in paying his portion of the lottery fee. (c) Advise Siwisa of his chances of winning the right to share in the lottery if he were to take the matter to a Court of Law.
