On April 2, Conners contracted to deliver 50 cubic yards of topsoil to Buck for grading the latter’s lawn. In spite of Buck’s telephoned requests, Conners had not delivered the soil by May 15, whereupon Buck purchased the topsoil from Perkins (without notifying Conners) and had the job finished by May 21. A week later Conners started delivery and insisted that Buck go through with the bargain. If litigation ensues, what result can be expected?
