3) Hypothetical: There is a suspicious fire and the police suspect Elijah of arson. When he is arrested, the police start questioning him without reading him his Miranda rights. While being questioned Elijah says “I’ll burn down your F---in’ houses, too, pigs.” You are a brand new lawyer assigned to the case. You think that the police violated his Miranda Rights. So at the initial appearance, you ask the judge to dismiss the case. He tells you to “go back to law school and come back when you know what to do!” At first, you’re insulted but then you realize why the judge was mad. What did you do wrong?
