William Furman was in court for committing the crime of killing a resident of the house he was burglarizing. In the Supreme Court, the death penalty was being considered as his sentence. However, Furman argued that his punishment was too cruel and unusual and that it violated the 8th and 14th Amendments which provided protection from “Cruel and Unusual Punishment”, and the right to “Due Process” and “Equal Protection”, under the law.
