Read the passage below: Sonia Sotomayor is the first Latina justice on the Supreme Court. However, though having a Latina justice with an activist past will help create a strong Latina presence in our
government, Sotomayor's racial background will not necessarily make her always rule in favor of racial issues in the courtroom. Sotomayor has a strong history of racial activism. She was a member of the Second Circuit Task Force on Gender, Racial and Ethnic Fairness in the Courts. In October 2001, she presented a lecture at UC Berkeley School of Law titled "A Latina Judge's Voice. She has given
over 180 speeches since 1993, about half of which focused on issues of race and ethnicity. She was also given the Outstanding Latino Professional Award in 2006 by the Latino/a Law Students Association.
However, her background in activism will not necessarily affect her rulings in the courtroom.
Regardless of her personal background, Sotomayor is fair and impartial in her rulings. An expanded study showed that Sotomayor rejected cases that involved claims of discrimination 90 percent of the me. In (2002),[129] Sotomayor dissented from her colleagues' ruling that
the New York Police Department could terminate an employee from his desk job who sent
racist materials through the mail. Sotomayor argued that the First Amendment protected
speech by the employee "away from the office, on [his) own time," even if that speech was "offensive, hateful, and insulting." In addition, a university study analyzing Sotomayor's cases that dealt with race and discrimination showed no clear ideological pattern in Sotomayor's
opinions.
