In 1944, federal judge Learned Hand gave a speech on the spirit of liberty, in which he reflected:

“I often wonder whether we do not rest our hopes too much upon constitutions, upon laws, and upon courts. These are false hopes; believe me, these are false hopes. Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it; no constitution, no law, no court can even do much to help it. While it lies there, it needs no constitution, no law, no court to save it.”

1. Which does Judge Hand believe is a more powerful force in society, the law or the hearts and minds of citizens?
Judge hand believes that the hearts and minds of citizens are more powerful than the law in society and I know this because in his speech he says “Liberty lies in the hearts of men and women; when it dies there, no constitution, no law, no court can save it.” In this part of the speech he is saying that without the hearts of men and women there is no constitution, law, or court.

2. To what extent does the Tom Robinson trial and its verdict in To Kill a Mockingbird reflect Judge Hand’s belief?
The Tom Robinson trial and it’s verdict reflects Judge Hand’s belief that the hearts and minds of citizens are more powerful than the law in society because the evidence of his trial points to Tom being innocent but then the jury’s beliefs of law made everyone believe that Tom was guilty.
