Haq and Renee are colleagues working at a multinational automotive company in Malaysia. Both is a Regional Manager for Johor and Sarawak. An advertisement has been placed on the company’s and major recruitment’s website to employ a new Country Manager located in Tokyo, Japan. Both want to negotiate with General Manager, Mr. Green, that they would excel and get promotes as “Country Manager”, from their current position as regional manager. This position will provide either one of them with many opportunities and benefits such as higher salary with more responsibilities and utilizing more of their technical and leadership skills. Besides, both have been working for the company for more than 5 years as a full-time employee and have made an enormous contribution to the organization. Haq is married but has no children. His wife is working as a medical practitioner in a government hospital in Johor Bharu. Haq is keen to try for the position as he knows that it will be a golden opportunity for him. However, he has not yet to discuss with his wife as they don’t get a chance to sit together due to his wife busy working schedule. With thought that his wife will be fine with his decision to try for the position, Haq decided to proceed to apply and will let her know afterwards. Renee is an extraversion personality which she likes being sociable, assertive, and talkative. She found herself is among the suitable candidate to apply for the position. However, she has trouble to suit herself with Japanese food. She once was food poisoning when eating the food from a Malaysian Japanese Food Chain in Kuching. Secondly, Renee may also face issue with her parents as they often ask when Renee will get married as she has reached her mid -30s. Renee thinks that she could counter that problem because she could find other types of cuisine in Tokyo easily, but not too sure over her parent acceptance about her decision moving to Tokyo.
Mr. Green has been receiving few potential resumes from the Human Resource Department including Haq’s and Renee’s. During a management meeting, the top management did ask him about the progress of hiring a new Country Manager. It looks like the top management does not want the position vacant for too long and pushed him to shorten the hiring process within a month. Mr. Green is being cautious since he wants to avoid from hiring a wrong candidate.

In december of 2004, the company you own entered into a 20-year contract with a grain supplier for daily deliveries of grain to its hot dog bun manufacturing facility. the contract called for "10,000 pounds of grain" to be delivered to the facility at the price of $100,000 per day. until february 2017, the supplier provided processed grain which could easily be used in your manufacturing process. however, no longer wanting to absorb the cost of having the grain processed, the supplier began delivering whole grain. the supplier is arguing that the contract does not specify the type of grain that would be supplied and that it has not breached the contract. your company is arguing that the supplier has an onsite processing plant and processed grain was implicit to the terms of the contract. over the remaining term of the contract, reshipping and having the grain processed would cost your company approximately $10,000,000, opposed to a cost of around $1,000,000 to the supplier. after speaking with in-house counsel, it was estimated that litigation would cost the company several million dollars and last for years. weighing the costs of litigation, along with possible ambiguity in the contract, what are three options you could take to resolve the dispute? which would be the best option for your business and why?
