Kevin operates his business from a small shop located next to an abandoned gas station. He is concerned that the gas station’s underground storage tank is in danger of rupturing. If this occurs, hazardous chemical substances will spill into the local drinking water.
Unable to locate any of the gas station’s three owners, Kevin files a petition with the Environmental Protection Agency (or "EPA") requesting that the EPA inspect the gas station as called for by the Comprehensive Environmental Response, Compensation, and Liability Act (or "CERCLA"). Kevin’s petition is granted, and the EPA determines that a potentially hazardous situation does exist at the gas station.
